Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the imarah platform, websites, mobile applications, and related services (collectively, the "Services") provided by Imarah. By accessing or using the Services you agree to be bound by these Terms. If you are using the Services on behalf of a Masjid or other organization, you represent that you have the authority to accept these Terms on its behalf.

2. Eligibility & Accounts

You must be at least 18 years old and authorized by your Masjid or organization to create an account. You are responsible for safeguarding account credentials and for all activities that occur under your account. Please notify us immediately at hello@imarah.io if you suspect unauthorized access.

3. Your Responsibilities

• Provide accurate program, enrollment, and financial information and keep it updated.
• Obtain any necessary consents from parents/guardians before adding student information.
• Maintain compliance with applicable privacy, education, and charitable regulations in your jurisdiction.
• Use the Services only for lawful purposes and in accordance with these Terms and posted policies.

4. Stripe & Payment Processing

imarah enables you to connect your Masjid's own Stripe account. All payment processing, settlement, and compliance obligations rest with your organization and Stripe. Imarah does not hold or control funds on your behalf. You are responsible for ensuring your connected account remains in good standing.

5. Platform Content & Ownership

We retain all rights, title, and interest in the Services and accompanying materials. You retain ownership of the data you submit to the platform. By uploading or otherwise providing data you grant us a limited license to use, store, and process it solely to operate and improve the Services.

6. Privacy

Our use of personal information is described in our Privacy Policy. By using the Services you acknowledge and agree that your information will be collected, used, and disclosed as described therein.

7. Suspension & Termination

We may suspend or terminate access to the Services if you violate these Terms, misuse the platform, or if we reasonably believe your actions expose us or others to liability. You may terminate at any time by discontinuing use and requesting account closure.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Imarah does not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Imarah WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Governing Law & Venue

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Alameda County, California, and you consent to the jurisdiction of such courts.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes we will provide notice (for example via email or in-product notification). Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
